When can I apply for US citizenship?
An EB-5 investor who has been a lawful permanent resident (LPR) for a minimum of 5 years may apply for U.S. citizenship. The 2-year conditional residency period (i.e. having a conditional green card) counts toward the 5-year requirement.
Additionally, to apply for naturalization to become a U.S. citizen, the EB-5 investor must:
- Be at least 18 years of age at the time of filing the application;
- Have continuous residence and physical presence in the United States;
- Be able to read, write, and speak basic English;
- Demonstrate good moral character;
- Demonstrate knowledge and understanding of U.S. history and government;
- Demonstrate loyalty to the principles of the U.S. Constitution; and
- Be willing to take the Oath of Allegiance.
Generally, an EB-5 investor intending to obtain U.S. citizenship should not stay outside the U.S. longer than 180 days in any given year without advance consultation with their immigration lawyer.
